Terms & Conditions
SCOPE OF WORK:
PHOTOGRAPHER (Salma Al-Hudaid) agrees to provide an agreed number of photos for CLIENT (You) as outlined in the contract/package. The Contract represents the entire understanding of the requirements, schedule, and payment terms for the corporate photoshoot services listed in the package and also serves as a model release.

PAYMENT METHOD:
The CLIENT agrees to retain the Photography for the services listed above by signing the contract and paying a deposit equal to x% of the total fee as agreed with the PHOTOGRAPHER or as stated in the contract/package. CLIENT acknowledges that no reservations can be made prior to the signature of the contract and subsequent payment of the initial service deposit.
The remaining balance for the above agreed photoshoot services shall be due in full prior to delivery as advised by the PHOTOGRAPER.
In the event that payment is not made in full by the deadline, PHOTOGRAPHER reserves the right to terminate this contract, retain the initial deposit, and no longer be held liable for providing further services to the CILENT.

PRICING:
Any additional goods or services not included in this contract will be sold at then current rates. PHOTOGRAPHER makes no pricing guarantees outside of the terms of this contract, and the CLIENT acknowledges that prices for additional goods or services are subject to change, suddenly and without notice.

CANCELATION:
The CLIENT may cancel this contract at any time up to three (3) days or as indicated by the photographer in the contract prior to the photoshoot date. To do so, CLIENT must send a written cancellation notice via email or certified mail. The CLIENT hereby forfeits their initial deposit in case of cancellation.

THE SCHEDULE:
Our shooting schedule, style of working and experience are designed to achieve a great set of photos for the CLIENT. Both the CLIENT and the PHOTOGRAPHER therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the events do not run-on time, we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate.

INDEMNIFICATION:

PHOTOGRAPHER and CLIENT agree that PHOTOGRAPHER is in no obligation to capture any specific moment, or pose, or person(s) during the shoot.

If PHOTOGRAPHER is unable to perform the services in this contract for any cause outside its control, CLIENT agrees to indemnify PHOTOGRAPHER for any damage, loss, liability; however, PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this shoot.

If PHOTOGRAPHER cannot perform the services in this contract in whole or in part due to any cause beyond the control of the parties or due to PHOTOGRAPHER’s illness or injury, then the PHOTOGRAPHER will return all fees to the CLIENT but shall have no further liability with respect to this Contract.

If there is the unlikely possibility that images may be lost, stolen, or destroyed for reasons in or beyond our control, liability is limited to the return of fees paid by the CLIENT for the service or part thereof according to the percentage of images supplied.

CLIENT agrees to indemnify and hold harmless the PHOTOGRAPHER for any liability, damage, or loss related to technological failure, including data loss.

CLIENT understands and agrees that the PHOTOGRAPHER is not required to maintain copies of the photos from this shoot more than sixty (90) days after the photos have been delivered to CLIENT.

CLIENT agrees that re-edits, if necessary, shall be requested fifteen (15) days after the initial delivery of the photos.

CLIENT agrees to hold PHOTOGRAPHER harmless for any personal injury, which may occur as the CLIENT poses or works with PHOTOGRAPHER.

PHOTOGRAPHER will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the CLIENT.

CLIENT agrees that they will receive edited images ONLY and no RAW files or unedited images will be given under any circumstance.

COPYRIGHTS:
All photographs and footage are and shall remain the sole intellectual property of the PHOTOGRAPHER in accordance with Canadian Copyright Laws. The CLIENT hereby waives any rights to intellectual property ownership, monetization, or reproduction of the images and footage created by the PHOTOGRAPHER, with exception of the terms of any formal written releases provided to the CLIENT by the PHOTOGRAPHER.
UNAUTHORIZED REPRODUCTION:
CLIENT agrees that all photos delivered to CLIENT are licensed for CLIENT’s personal use only. Selling, Publication or any Commercial use of the photographs is not allowed without prior permission from the PHOTOGRAPHER.

HOUSE RULES:
Note that the PHOTOGRAPHER is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that flash photography is prohibited, and others will insist that PHOTOGRAPHER may only photograph at a certain point. In such circumstances, the CLIENT agrees to accept the technical limitations that may be imposed on the equipment used. We advise the CLIENT to make themselves aware of the rules of the venue concerned. And if necessary, negotiate with the personnel concerned.
DELIVERY:
PHOTOGRAPHER will deliver proofs of photos to CLIENT no later than the date specified by the PHOTOGRAPHER in the contract after the date of the SHOOT. The CLIENT is responsible for collecting the Package when ready and the final balance will be due prior to delivery.
